Copyright - Overview

Copyright right is a property right which arises automatically in the following types of work:

bullet

Original literary works which have been recorded, including tables, compilations and computer programs.

bullet

Original dramatic works which have been recorded.

bullet

Original musical works which have been recorded.

bullet

Original artistic works, namely:
bullet

Graphic works (such a paintings, drawings, diagrams, maps, charts, engravings, etchings, lithographs, woodcuts and similar), photographs, sculptures (including sculpture casts or models) and collages, all irrespective of artistic quality;

bullet

Architectural works in the form of a building, part of a building or model thereof; and

bullet

Works of artistic craftsmanship.

bullet

Sound recordings.

bullet

Films (including videos).

bullet

Broadcasts and cable programmes.

bullet

Typographical arrangements of published editions.

For a limited period of time, the owner of the copyright can take legal action to prevent:

bullet

Unauthorised copying of the work;

bullet

Unauthorised issuing to the public of copies of the work;

bullet

Unauthorised public performance of the work, in the case of a literary, dramatic or musical work;

bullet

Unauthorised broadcasting or inclusion in a cable programme of the work, in the case of a literary, dramatic or musical work, sound recording, film, broadcast or cable programme;

bullet

Recording an adaptation of the work, in the case of a literary, dramatic or musical work.

Copyright does not give the owner the right to stop others dealing in a work which, although similar, has been created independently without copying.
